Terms of Service

These Terms of service govern all purchases, session bookings, and digital transactions made through this platform. By completing your transaction you enter into a contract under the terms outlined below.

1. Purpose & Scope of Practice

1.1 Educational Purpose: The coaching services provided utilize the VITA™ methodology, focusing on somatic awareness, emotional integration, developmental growth, and personal empowerment.
1.2 Professional Trainee Status: The Client acknowledges that the Coach is currently in professional training for VITA™ Certification. Sessions conducted are a documented part of the Coach’s professional portfolio development. The Client participates as an active coaching partner within this educational framework.
1.3 Non-Medical & Non-Therapeutic Disclaimer: Coaching is strictly a developmental and educational process. It is not psychotherapy, psychiatric treatment, or medical healing (Heilkunde). The Coach does not diagnose, treat, or provide "cures" (Heilung) or "alleviation" (Linderung) for clinical disorders, mental illnesses, or physical conditions. Coaching is not a substitute for professional medical or mental health advice.

2. Service Format & Cancellation Policy

2.1 Session Format: Standard sessions are 60 minutes in length and conducted online via video platforms (Zoom or Google Meet).
2.2 24-Hour Cancellation Policy:
* Cancellations must be made at least 24 hours prior to the scheduled session time.
* Sessions canceled with less than 24 hours' notice, or missed entirely without notice (no-show), are non-refundable and forfeited.
* Repeated late cancellations & no-shows (more than 2 occurrences) reserve the Coach’s right to terminate the agreement to honor time availability.

3. Financial Terms, Pricing & Taxes

3.1 Payment Terms: Payment is due in full at the time of booking via a payment link or bank transfer prior to session delivery.
3.2 Tax Exemption Notice (§ 19 UStG): Prices stated are final. In accordance with § 19 UStG (German Small Business Regulation / Kleinunternehmerregelung), no Value Added Tax (VAT / Umsatzsteuer) is charged or invoiced.
3.3 Invoicing: Digital tax-compliant invoices are sent via email after transaction completion.

4. Data Privacy, Technology & Record Retention

4.1 Digital Tools: Sessions are hosted via Zoom or Google Meet, and payments are processed through Stripe. These service providers comply with EU data protection standards, including the EU-U.S. Data Privacy Framework (DPF). While technical measures (encryption, 2FA) are maintained, the Client acknowledges inherent risks involved in digital communications.
4.2 Administrative Data Storage: In compliance with § 147 AO (German Tax Law), administrative data, transaction logs, contracts, and invoices are retained securely for a statutory period of 10 years.
4.3 Privacy Rights: All personal data is handled in strict compliance with the European General Data Protection Regulation (GDPR / DSGVO).

5. Limitation of Liability & Governing Law

5.1 Limitation of Liability: The Coach is only liable for damages caused by intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit). Liability for minor negligence (einfache Fahrlässigkeit) is excluded, except in cases involving injury to life, body, or health. Financial liability for any claim is capped at the total amount paid by the Client for the specific transaction.
5.2 Governing Law: These terms are governed exclusively by the laws of the Federal Republic of Germany.
5.3 Jurisdiction: The place of jurisdiction for all legal disputes arising from this contract is Stuttgart, Germany.
5.4 Severability Clause: If any individual provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions shall remain in full force and effect.
